ARSA
These are land plots on which a foreign owner can build a house, instead of buying a finished home. According to the law, citizens from abroad can buy land in Turkey for the construction of residential and commercial premises with an area of up to 3 hectares. In the first case, you can build a house or a villa on the site, in the second, a hotel, office or store. TARLA
Agricultural plots are used for the needs of agriculture (animal husbandry, pastures, growing olive, banana, orange plantations, other fruits and vegetables, cotton, grain, etc.). Their cost is significantly lower than building land. Every foreign citizen has the right to become the owner of land with an area of up to 30 hectares. Foreigners are prohibited from buying state-owned land plots. Basically, these are territories where there are any minerals, forest, pasture, beaches, etc. I will add that such allotments are not subject to sale by the Turks themselves. However, the land owned by the state can be leased out on a long-term basis.
Foreigners cannot buy or lease strategically important sites (on the territory of military bases, national parks, etc.). In particular, Ukrainians and Russians will not be able to acquire land on the Black Sea coast, and Greeks – on the shores of the Mediterranean and Aegean Seas.
HOW TO BUY LAND FOR A FOREIGNER?
It is quite easy for a foreign citizen to buy land for construction in Turkey. To do this, you only need to have a passport with you. The property is registered as an ordinary apartment or villa. After choosing an object, a sale and purchase transaction is concluded, which consists of two stages:
submission of documents and conclusion of a transaction;
registration of land ownership.
Submission of documents takes place at the Cadastral Department at the location of the land. According to the legislation, a mandatory document is a certificate of the current cadastral value of the site.
As soon as the deal is concluded and all settlements between the buyer and the seller are made, you, as a new owner, will be given a TAPU for the land plot.
If you are going to buy a land plot in Turkey for agricultural work, you will need to register a legal entity. In this case, you can act in two ways:
Submit an application through the city administration, register a company in your own name and wait for a response from Ankara, but this will take a fairly long time.
Registration of a company for a Turk and the purchase of a land plot you like through it. After that, a ready-made company, which owns this land, is redeemed by you as a foreigner. This method is simpler and more convenient, therefore it is more popular among foreign investors.
By the way, on such a site you can build a small house, but it should not occupy more than 5% of the total area. If you want to build a spacious house or a villa with several floors, you will need to obtain a building permit from the city municipality and transfer the status of the land from “tarla” to “arsa”. After that, it will be possible to build up already 20% of the total area of the land plot.
It is important to know that the municipality will include the land transferred to the new “arsa” status in the cadastral plan of the city, and the area of your land plot itself may decrease by 30-40%.
